REGULAR SESSION MONDAY EVENING MAY 4, 2020

The Governing Body of the City of Silver Lake met in regular session on Monday evening May 4, 2020, with Mayor Mack Smith conducting the meeting and the following Councilmembers present: Larry Ross, Brad Bryant, Tim Kampsen, Heath Robinson, Tom Noble (5). Also present were City Attorney Luckman, Police Chief Call (by conference call), Public Works Assistant Smith, Clerk Brown, and Assistant Clerk Beam.

Motion was made by Councilmember Ross and seconded by Councilmember Noble that the minutes from the last regular session held on April 20, 2020, be approved as written.
 
Motion was made by Councilmember Ross and seconded by Councilmember Noble that the minutes from the Special Meeting held on April 29, 2020, be approved as amended. In paragraph 17 Sr. Mary’s Star needs to be changed to St. Mary’s Star.
 
Councilmember Bryant presented the monthly financial report.
 
Claim vouchers in the amount of $5284.99 were submitted to Council for appropriation. An ordinance entitled "An ordinance appropriating money to pay certain claims" was introduced and read at length. Motion was made by Councilmember Noble and seconded by Councilmember Robinson that said ordinance be accepted as read with no further discussion motion was then placed on final passage by roll call vote of the following vote: AYE: Larry Ross, Brad Bryant, Tim Kampsen, Tom Noble, Heath Robinson NAY: None. The ordinance was declared passed and was given No. 2454.
 
Councilmember Noble made motion to not add late fees or shut off water for the water bills due April 30, 2020, that have not been paid. Councilmember Ross seconded the motion with no further discussion the motion carried.

Jeff Reamer along with Gary Musselman and Mike Kruger were presented to Council to fill the vacant 2 spots on the Planning Commission. One person who lives outside of city limits by 3 miles and one person that lives in city limits. Mayor Smith proposed that Council appoint Jeff Reamer and Gary Musselman to the planning commission. After consideration by Council, motion was made by Councilmember Noble to approve Reamer and Musselman for the committee. Motion was seconded by Councilmember Ross and after discussion was approved.
 
In accordance with the statutes, Mayor Smith has prepared for council a list of the following names for appointive office to the City of Silver Lake for a one (1) year term: City Clerk – Michelle Brown; Assistant; City Clerk – Marie Beam; Public Works Superintendent – Ron Taylor; Public Works Assistant – Willie Smith; Part-Time Public Works Employee – William Neary; Summer Help – Jake Wegner; Police Chief – Randall Call; Full-Time Police Officer – Brad Snyder; Part-Time Police Officer – Doug Ashcraft; Part-Time Police Officer – Trent Stanley; Part-Time Police Officer – Gage Steckle; City Attorney – Todd Luckman; City Judge – Alan Streit. Motion was made by Councilmember Noble that Mayor Smith’s recommendations be accepted. seconded by Councilmember Ross after further discussion Councilmember Kampsen asked to be moved from the park department. Councilmember Ross was then appointed to the Park Department and Councilmember Kampsen was appointed to the Police Department. Councilmember Noble approved the amendment to the motion and seconded by Councilmember Ross, with no further discussion motion was approved 

Police Chief Call presented the monthly police report.

Public Works Assistant Smith presented the monthly water report. During this time of year, there are more water samples to do.

Public Works Assistant Smith reported that Jake Wegner has agreed to return this year to fill the Part-Time Summer Help position. Motion was made by Councilmember Kampsen that the salary for this position is

$11.00 per hour. Motion was seconded by Councilmember Noble and with no further discussion, motion was approved.

Public Works Assistant Smith reported that a resident has a complaint about rats living in the bushes on the easement behind his house. Discussion was held on whether the bushes are on the residents’ property or property that the City is responsible for taking care of. If the bushes are on the owner’s property it is up to the owner to take care of the nuisance.

It was brought to Councils’ attention that the City currently doesn’t have a designated officer to approve building codes. City Attorney Luckman was asked to bring samples of what other Cities do for this.

Police Chief Call reported the D.A.R.E. graduation will be a drive-through on May 14, 2020, at 6:00 P.M. to 7:00 P.M.  

New Court Cost charge will take effect this month. 

The radar equipment was updated in the police vehicles.

In Councils’ packet was an ad for the Public Works Assistant position that is currently open. Motion was made by Councilmember Noble to advertise for this position. Motion was seconded by Councilmember Kampsen with no further discussion motion was approved. 

Council directed staff to refund any deposits made for the public reserving the community center through June.

In Councils’ packet was an ordinance for the new Public Works Superintendent salary starting June 1, 2020. The salary was approved at the Special Meeting on April 29, 2020, but Council did not have an ordinance number at that time. After reading this ordinance Councilmember Noble made motion to approve Salary Ordinance 2453 Councilmember Robinson seconded motion and with no further discussion, motion was approved.

Discussion was held on having a retirement reception and to give a gift to the retiring Public Works Superintendent. Councilmember Noble moved to provide a retirement gift and have a retirement reception for the retiring Public Works Superintendent in appreciation of his many years of service to the City. Motion was seconded by Councilmember Robinson and with no further discussion, motion was approved.

City Attorney Luckman noted that the survey was done on a property on Chilson Rd. The water line is 2 ft. off of the easement.  

City Engineer Pat Cox recommended to pothole to find where the water line is. 

Public Works Assistant Smith is going to get a quote on potholing to find the waterline and a quote on moving the waterline.

Councilmember Kampsen made motion to not to exceed $2,000 to pothole. Councilmember Robinson seconded the motion with no further discussion the motion was approved. 

Councilmember Kampsen asked questions about the ball donations and the donation that was given to the 150th committee. Ball donations have not been given this year, yet. They are planned for the next meeting.

Councilmember Noble noted he is concerned about the dirt that is piled on top of the ditch on Chilson. Public Works Assistant Smith noted there is not a right away along the side of the road.

Engineer Pat Cox noted that we need to follow the Kansas Department of Health guidelines when moving the water line in connection with the sewer line.

Street project deadline is June 1, 2020, at 5:00 p.m.

Mayor Smith noted he had a complaint about the ditch drainage in front of a house on Aquarius.

The next meeting is scheduled for May 18, 2020, at 5:30 P.M. The meetings after are scheduled for June 1, 2020, with street bids starting at 5:00 P.M. and regular session meeting at 5:30 P.M. and on June 15, 2020, at 5:30 P.M. 

With no further business to come before council, Councilmember Noble moved to adjourn the meeting at 6:50 P.M. Motion was seconded by Councilmember Robinson and with no further discussion was approved.
